By accessing and utilising the Website (www.bhavyaliving.com) or making a purchase through its services, you unconditionally and irrevocably agree to be bound by these Terms and Conditions. Bhavya Art and Crafts reserves the right to review and amend these terms at its sole discretion at any time.
Article I: General Provisions and Corporate Identity
Section 1.01 Ownership and Operation The Website, www.bhavyaliving.com, is owned and operated by Bhavya Art and Crafts.
Section 1.02 Registered Office PLOT NO-6, KHASRA NO-161, RAMNAGAR, SANGARIA, JODHPUR (RAJ.) INDIA.
Section 1.03 Applicability: These Online Shopping Terms and Conditions shall govern every purchase transaction initiated through the services of this Website.
Article II: Product Representation and Intellectual Property
Section 2.01 Product Accuracy Disclaimer While every commercially reasonable effort is made to ensure product perfection, the display of colors, shades, textures, sizes, and appearances on the Website is dependent upon the user's computer screen settings and resolution.
Section 2.02 Request for Supplementary Media Customers may request supplementary product photographs, beyond those displayed online, by emailing care@bhavyaliving.com
Section 2.03 Product Variation Notification Due to the use of natural materials, variations are inherent. Specifically, a slight variance in fabric color and wood polish between the image and the actual product may occur. Natural wood and marble grain variations are expected across all solid wood furniture.
Section 2.04 Website Copyright The design, structure, and underlying software of this Website are protected by copyright. Any form of unauthorized reproduction or imitation is strictly forbidden.
Section 2.05 Corporate Trademarks and Logos All trademarks, service marks, and logos displayed on the Website are the exclusive property of BHAVYA ART AND CRAFTS. Unauthorised use of any such mark is strictly prohibited without the Company's prior written consent or the written permission of the respective third-party owner.
Section 2.06 Social Media Intellectual Property All content posted by the Company across its official social media channels, including Google Plus, Facebook, Twitter, YouTube, Pinterest, and Instagram, is protected under the Company's copyright.
Article III: User Obligations and Prohibited Conduct
Section 3.01 Prohibited Content Upload The user is prohibited from uploading, displaying, hosting, modifying, transmitting, circulating, or sharing any information that is:
- (a) Not the property of the user.
- (b) Unlawful, harmful, harassing, defamatory, vulgar, obscene, pornographic, pedophilic, libellous, or invasive of another's privacy.
- (c) Hateful, racially, or ethnically objectionable, or encouraging money laundering or illegal activities.
- (d) Infringing upon any intellectual property rights, including patents, trademarks, and copyrights.
- (e) In violation of any law currently in force.
- (f) Misleading in nature or impersonating any individual.
- (g) Containing software viruses or malicious computer code designed to impair or limit the functionality of any resource.
- (h) Threatening the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order.
Article IV: Financial Transactions
Section 4.01 Credit/Debit Card Warranties By providing credit/debit card information, the user explicitly warrants the accuracy and validity of the details and confirms that they are the rightful account holder.
Section 4.02 Data Security and Non-Disclosure Financial data provided by the user will not be used or shared with any third party, except as required for necessary fraud proofs under legal guidelines or by court order.
Section 4.03 Fraud Liability The Company shall not be held liable for any credit card fraud that occurs. The sole responsibility and burden of proving fraud shall rest with the user.
Article V: Returns and Logistics
Section 5.01 Return Packaging Requirement: For all reverse pickup arrangements, it is a prerequisite that the product packaging remains intact and utilizes its original box. Returns cannot be accepted if the packaging is not in its original, undamaged condition.
Article VI: Dispute Resolution and Jurisdiction
Section 6.01 Governing Law This agreement, including all documents incorporated by reference (such as the Privacy Policy), shall be exclusively governed by and construed in accordance with the laws of India.
Section 6.02 Exclusive Jurisdiction Any legal proceedings arising out of or relating to this agreement shall fall under the exclusive jurisdiction of the Courts in Jodhpur, Rajasthan, India.
Section 6.03 Arbitration Clause In the event of a dispute between the Company and the customer regarding the validity, interpretation, execution, or alleged breach of any provision of this agreement, the matter shall be referred to a sole arbitrator. The arbitrator must be an independent and neutral third party formally recognized and appointed by the Company.
